I know somebody already addressed this, but show me any lawsuit RoXoR started and I'll give you the point.
Edit: Plus when you consider the fact that Kyle Ward has been known to sign burned DVD copies of the game and I believe at one point said that he didn't care what people did to ITG once they bought it (in regards to hacking machines to add more songs), and that Kyle Ward is a relatively big person behind ITG, I can't see how you can draw any parallel here.
